A crop dusting company
forced to pay more than $460,000 for damaging a neighbor's cotton crop
in 2005 has lost again after fighting the decision in the Supreme Court.

Aerial Spraying and its managing director Lachlan Hill appealed the
2011 decision which found that spray had traveled from the targeted
wattle trees to Ash Geldard's property some 20km away.
Within days the cropped had yellowed and the cotton's yield began to fall.
Hill
and the spraying firm appealed on the grounds that the first trial
judge had made a mistake on what duty of care the sprayer had when crop
dusting.
However, all three judges last week dismissed the appeal with costs.
