Sherree McCulley and Paul McCulley of Woodlyn filed a lawsuit Feb. 2 in U.S. District Court for the Eastern District of Pennsylvania against US Airways Inc, US Airways Group Inc and American Airlines Group Inc, alleging negligence.
According to the complaint, on March 13, 2014, the McCulleys were on US Airways Flight 1702 at Philadelphia International Airport when the the crash occurred. The suit states two days before the flight, pilot John D. Powell had been given two medications which rendered him unfit to fly for 60 hours. However, he reported to work 45 hours later, the suit says.
The lawsuit says Powell attempted to operate the plane but brought his plane back to the ground after ascending 70 feet, causing it to skid 2,000 feet. The complaint alleges Sherree McCulley sustained multiple injuries as well as post-traumatic stress syndrome, which have impacted her earning capacity.
The plaintiffs say her injuries resulted in medical bills, mental anguish, loss of earnings and loss of consortium.
The McCulleys seek a jury trial and legal fees, as well as punitive and compensatory damages. They are represented by attorney Francis J. Curran Jr. of The Curran Firm PC in Media.

On March 13, 2013, at about 1830 eastern daylight time (EDT), US Airways flight 1702, an Airbus A320, N113UW, experienced a nose gear collapse and other damage after aborting the takeoff on runway 27L at Philadelphia International Airport (KPHL), Philadelphia, Pennsylvania. The airplane came to rest on the edge of the runway, and the passengers exited the aircraft via the emergency slides. There were no injuries to the passengers and crew members and the airplane was substantially damaged. The flight was operating under 14 Code of Federal Regulations Part 121 as a regularly scheduled passenger flight between KPHL and Hollywood International Airport, Fort Lauderdale, Florida.
