KEYSER, W.Va. — A preliminary injunction that the former Greater
Cumberland Regional Airport manager sought against the Potomac Highlands
Airport Authority was denied Monday in Mineral County Circuit Court,
according to Ramon Rozas III, attorney for the authority.
Terry Malone’s lawsuit against the authority seeking to gain access to
the property and damages for being barred from the property was
dismissed by Judge Phil Jordan.
The authority filed a countersuit against Malone for not returning the
keys to the authority building, according to Rozas. In March, Rozas sent
a letter requesting that the keys be returned within 10 days of receipt
of the letter.
The letter also advised Malone that he was barred from the property
without subsequent expressed written permission from the authority. If
Malone didn’t adhere, he would be considered to be trespassing and all
applicable civil and criminal remedies would be pursued, according to
the letter. Since the preliminary injunction was denied and the lawsuit
was dismissed, everything is back to status quo, said Rozas. Malone
still isn’t allowed on airport property without written permission.
“If he has a legitimate business reason, all he has to do is ask (to be
on the grounds). From our perspective, he doesn’t have legitimate
business, he doesn’t have a plane and he is not employed at the
airport,” said Rozas in a previous interview with the Times-News.
Malone was fired from his position as airport manager last year but
remained a member of the authority. Malone resigned from the authority
following a heated executive session in February.
An attempt by the Times-News to reach Malone was unsuccessful.
