Lusaka High Court reserves ruling in Zambezi airlines case

THE Lusaka High Court has reserved ruling in a matter in which Zambezi Airlines has sought judicial review over the Government's decision to suspends operations.
High Court Judge Albert Wood reserved the ruling in chambers yesterday to a later date and asked both parties to make written submissions.

This is in a matter in which Zambezi Airlines has asked for review of the suspension of its operating license by the Government. The airline is seeking a court order to quash the decision by Transport, Works and Supply Permanent Secretary, Dominic Sichinga to suspend the license.

The airline has stated that the suspension of its license was illegal as it lacked jurisdiction, and argued that the director of civil aviation acted illegally by invoking legislation that had not been enacted in Zambia to arrive at the suspension.

Zambezi Airlines has also contended that the verdict to suspend the air permit was in defiance of the rule of natural justice as the airline was not given an opportunity to defend itself.
